1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the B3 Property Management Solutions platform ("Service", "B3PMS") operated by B3 Property Management Solutions. By accessing and using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. The Service
B3PMS provides a web-based property management platform for estate agents and property professionals. The Service includes functionality for managing properties, rents, maintenance jobs, tenant communications, reporting, and related property management tasks. The Service is delivered via www.b3pms.com and the business console portal at portal.b3pms.com.
3. Account Registration
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding the password that you use to access the Service and for any activities conducted under your password.
4. Subscription & Payment
B3PMS operates on a subscription basis. By subscribing to a plan, you agree to pay the applicable subscription fees, including all taxes, in the manner specified. Subscription fees are non-refundable unless otherwise stated in the applicable plan. We reserve the right to modify the subscription fees with 30 days' notice.
5. User Conduct
You agree not to use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You are responsible for any content you upload, post, or otherwise make available through the Service.
6. Intellectual Property
The Service and its original content, features and functionality are owned by B3PMS and are protected by international copyright, trademark, patent, trade secret and other laws. The Service is protected by copyright law as a collective work and/or compilation, which means we own a copyright in the selection, coordination, arrangement and enhancement of the features and functionality. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of B3PMS.
7. Termination
B3PMS may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, B3PMS shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, or other intangible losses, resulting from your access to or use of the Service, or your inability to access or use the Service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which B3PMS operates, without regard to its conflict of law provisions. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
